Cops Investigate Killing of Rancher in New Mexico Border Town


STEINS, N.M. -- New Mexico state police and the U.S. Border Patrol are investigating the killing of a rancher about 100 miles from the Mexican border.
State police Maj. Scott Weaver says 68-year-old rancher Larry Link was found dead about 6:15 a.m. Tuesday outside his ranch in Steins in Hidalgo County, which borders Mexico and Arizona.
Weaver says the killing is being investigated as a homicide and there are no suspects. He declined to release any other information about the case.
But the president of the union that represents border patrol agents says Link was shot twice and his body was found next to his vehicle.

Supreme Court Passes on Case on Tuition Break for Illegals


A California law that gives illegal aliens a break on college tuition and resembles a controversial proposal before Congress will not get closer scrutiny by the Supreme Court.
The justices announced Monday they will not hear arguments in a case brought by thousands of California college students who pay out-of-state tuition rates. The students object to a state law allowing their classmates, who are illegal aliens, the conditional ability to pay in-state or "resident" rates.
The dispute comes as some lawmakers on Capitol Hill continue to press for passage of the DREAM Act. The legislation allows illegal aliens to earn citizenship by attending college or enlisting in the military.
While the case centers on a California law designed to benefit illegal immigrants, the state's legal case is very similar to the arguments used by other states, namely Arizona, which have pursued legislation to crack down on illegal aliens. In each instance, the states claim that its law is not preempted by Congress.
The student opponents of California's 2001 measure contend the tuition break directly conflicts with the main federal immigration law passed five years earlier. 
"In the absence of guidance from this court, numerous states have circumvented federal law in this area with impunity," lawyer Kris Kobach wrote in February, asking the justices to take the case. "They have done so by urging a reading of federal law that reduces it to a dead letter and is contrary to every expression of congressional intent on the matter."
Kobach contends that federal immigration law prohibits the special kind of residency tuition break California passed unless the benefit is also available to all Americans. In other words, the California measure can only be allowed if all U.S. residents equally qualify for the in-state tuition rate specifically extended to illegal aliens.
In November, the California Supreme Court upheld the state law concluding "the exemption is not based on residence in California. Rather, it is based on other criteria." It pointed to situations where non-resident students could nonetheless qualify for the "resident" tuition status.
For example, any student with three years' attendance at a California high school qualifies for the break regardless of his or her home address. This would cover students who crossed the state line to attend a California school, boarding students whose parents live in a different state or students who moved away but wanted to return for college. 
"If Congress had intended to prohibit states entirely from making aliens eligible for in-state tuition, it could have easily done so," Justice Ming Chin wrote for a unanimous court.
Late last year, the House of Representatives passed the DREAM Act that would among other things repeal the in-state tuition ban found in the 1996 immigration law. Senate backers have been unsuccessful in getting the bill to President Obama who fully backs the measure. Opponents have blasted the measure as an amnesty for people who've illegally entered the country.
Kobach says the inability of federal lawmakers to pass the DREAM Act "has not dissuaded some state legislatures from taking an alternative path: simply circumventing federal law."
Nebraska, New Mexico, New York, Texas, Utah and Washington are some of the other states that have passed similar laws. The difference between "resident" and "nonresident" tuition for four years of undergraduate studies at Cal-Berkeley, for example, is $91,512.
The justices offered did not explain why they decided against taking the case.

Wisconsin Reopens Fight Over Collective Bargaining


MADISON, Wis. -- The Legislature's budget committee reopened the fight over collective bargaining rights shortly after midnight on Friday, proposing that newly hired police and firefighters be forced to pay more for their health insurance and pension benefits.
The change, approved by the Republican-controlled committee on an 11-4 party line vote, would force police and firefighters to make the same level of contributions of other public workers as required under a bill pushed by Gov. Scott Walker and passed by the Legislature in March.

U.S. Offers Foreign Aid to Countries Holding Billions in Treasury Securities

The United States is providing hundreds of millions of dollars of foreign aid to countries that it borrows billions from, according to a report by Congress's research arm.
The Congressional Research Services released a report last month, a copy of which Fox News exclusively obtained, showing that in fiscal year 2010, the latest year that data was available, the U.S. handed out a total of $1.4 billion to 16 foreign countries that held at least $10 billion in Treasury securities, including China ($27.2 million), Brazil ($25 million), Russia ($71.5 million), India ($126.6 million), Mexico ($316.7 million) and Egypt ($255.7 million).
China is the largest holder of U.S. Treasury bonds with $1.1 trillion as of March, according to the Treasury Department. Brazil held $193.5 billion, Russia had $127.8 billion, India owned $39.8 billion, Mexico held $28.1 billion and Egypt had $15.3 billion.

Limousine Liberals


Obama administration officials are riding in style. 
A new report from a watchdog group shows that the number of limousines owned by the federal government rose by 73 percent during the first two years of President Obama's administration. The State Department was the recipient of most the new luxury vehicles. 
The "Limousine Liberals?" report from iWatch News, part of the nonprofit Center for Public Integrity, showed that government data pegged the number of limos in the federal fleet at 412 in fiscal 2010, up from 238 in fiscal 2008. President Obama's motorcade travels along the Mall as it leaves Buckingham Palace to go to Downing Street in central London May 25.

Michele Bachmann to Media: I’m No Sarah Palin 2.0

You’d probably expect Rep. Michele Bachmann -- three-term member of Congress, founder of the House Tea Party Caucus, parent to 23 foster children, and one of Time Magazine’s 100 Most Influential People in the World -- to be judged on her own merits. But whenever you find Bachmann’s name in the headlines these days, it seems Sarah Palin’s name isn’t far behind.

And some observers are starting to suspect it’s no accident.

“A Tea Party Favorite Stirs Iowa. No, Her Name Isn’t Palin,” touts one New York Times headline. “GOP Has a Lightning Rod, and Her Name Is Not Palin,” declares another. A lead story on Politico on Friday was titled, “Palin, Bachmann Size Each Other Up.”

Of course, headline writing these days is designed to pack popular search terms into one line. But if Bachmann, a Minnesota Republican, announces next month as expected that she’s running for the GOP 2012 presidential nomination, she’ll have to find a way to put the Palin comparisons behind her.

At times, it’s almost as if Bachmann is viewed by the media as an updated version of Sen. John McCain’s 2008 running mate -- a Palin 2.0. On Thursday, Bachmann had to remind reporters that no two competitors “are interchangeable.”

Illegal Immigrant Arrested in Death of Texas Police Officer


A motorist accused of killing a Houston police officer while driving drunk is in the country illegally, MyFoxHouston.com reports.
Police say Johoan Rodriguez was drunk when he drove his car into a road block Sunday morning, striking and killing Officer Kevin Will with the Houston Police Department.
Rodriguez has since been charged with intoxication manslaughter of a peace officer, felony evading, and possession of a controlled substance. Police say he had .3 grams of cocaine in his pocket along with an alcohol level of .238, according to the station.
At a probable cause court hearing late Sunday night, it was learned that Rodriguez is in the country illegally. A judge refused to give the suspect any kind of bond, and his first court date was set for Wednesday.
Officer Will died a hero. The 38-year old officer couldn't get out of the path of an alleged drunk driver, but the officer did save a citizen's life.
“He credits officer Will with giving him the prior warning of yelling 'get out of the way,’” HPD Chief Charles McClelland told the media Sunday afternoon. “It actually saved his life.”

Supreme Court Sides With Arizona on E-Verify


VICTORY! The case of U.S. Chamber of Commerce v. Whiting, et al. (09-115)
In a 5-3 decision, the United States Supreme Court upheld an Arizona law called the Legal Arizona Workers Act which makes it illegal for employers in the state to intentionally hire an illegal alien, and it gives county attorneys authority to enforce this restriction, with escalating penalties for employer violations.
Frustrated at Congress’s inability — or unwillingness to close the borders and crack down on employers who prefer to hire illegal aliens over American workers, state and local governments began adopting their own policies to deal with the 30 million non-citizens who have entered the country illegally.
Nowhere has that effort been more energetic than in Arizona, which shares a 389-mile-long border with Mexico.   The State of Arizona decided that, in the vacuum created by the federal government, it would take matters into its own hands, regarding arrest and detention of illegal aliens, employment verification requirements and other policies it deemed necessary to protect the citizens of that state.

High Court Upholds Arizona Law Penalizing Employers Over Illegal Immigrant Workers


WASHINGTON -- The Supreme Court has sustained Arizona's law that penalizes businesses for hiring workers who are in the United States illegally, rejecting arguments that states have no role in immigration matters. 
By a 5-3 vote, the court said Thursday that federal immigration law gives states the authority to impose sanctions on employers who hire unauthorized workers. 
The decision upholding the validity of the 2007 law comes as the state is appealing a ruling that blocked key components of a second, more controversial Arizona immigration enforcement law. Thursday's decision applies only to business licenses and does not signal how the high court might rule if the other law comes before it.

It's All Your Money: Foreign Aid to Muslim/Arab nations


While America's standing in the Middle East couldn't get much lower, you wouldn't know it looking at the U.S. foreign aid budget. Of proposed U.S. assistance for 2012, almost two-thirds is earmarked for Muslim nations and one-third goes to Arab countries.
Yet, despite those billions in aid, opinion polls show most Arab citizens still have an unfavorable view of America and most Muslim nations routinely vote against U.S. interests in the United Nations.
"If we are giving money to countries consistently voting against our interest, we ought to cut them off," says Congressman Steve Chabot (R-OH) who sits on the House Foreign Affairs Committee. "But Congress is going to need to get some backbone here because it consistently gives Presidents the ability to waive the cutoff of that money."
Years ago, U.N. Ambassador John Bolton proposed cutting off all aid to the 30 nations who consistently voted against the U.S. in the UN. Before him, President Reagan's U.N. Ambassador Jeane Kirkpatrick proposed cutting off $1 million in aid for each vote an aid recipient cast against the U.S. in the U.N. In both cases, Bolton says the State Department overruled them.
"Foreign aid to a lot of countries could be readily cut and I think it's been a mistake by the U.S. government for decades not to take U.N. voting into account," Bolton said Monday.
This document, released by the State Department, examines 13 critical votes in the UN in 2010.
Compare that to this list of US aid recipients for 2012 and this poll released last week by the Pew Research Center Global Attitudes Project.
The result: some of the largest recipients of U.S. taxpayer money over the last 6 budget years consistently vote against the U.S. and harbor negative or unfavorable views of America.

Tax Delinquents Collected Billions From Obama's Economic Stimulus Plan


WASHINGTON -- Thousands of companies that cashed in on President Obama's economic stimulus package owed the government millions in unpaid taxes, congressional investigators have found.
The Government Accountability Office, in a report being released Tuesday, said at least 3,700 government contractors and nonprofit organizations that received more than $24 billion from the stimulus effort owed $757 million in back taxes as of Sept. 30, 2009, the end of the budget year.
